Japanese Plant Variety Rights (JPN PBR)

The Japanese market for (ornamental) plants can potentially be a lucrative market for European bred cultivars. The Japanese enjoy new and unique (and abnormal) plants, where extremes are appreciated. The executive body is the Ministry of Agriculture, Forestry and Fisheries (MAFF), located in Tokyo.

An application in Japan consists of completing and signing several forms and a plant description. After the application is filed, a DUS test follows. This DUS test is identical to the DUS test for EU PBR, except that a selected nursery in Japan performs it.

When JPN  PBR is granted, it has to be renewed each year. This is done similar to the EU PBR, by paying an annual fee. After a maximum of 25 years your rights expire.
